Streamline HiFi LLC Terms of Sale, Limited Warranty, and Service Agreement

IMPORTANT NOTICE:

By completing a purchase or accepting delivery of any product or service from Streamline HiFi LLC (“Streamline HiFi,” “Seller,” “we,” “us,” or “our”), you (“Buyer” or “you”) agree to be bound by these Terms of Sale, Limited Warranty, and Service Agreement (the “Agreement”). Please read these terms carefully.

SELLER STATEMENT:

We’re a small family-focused business, and these terms are here to protect both us and you by ensuring clear expectations. This agreement in no way takes away from the quality or fantastic experience you will get with Streamline HiFi. In fact, it ensures that the quality and overall experience remain top tier by clearly outlining how we handle warranties, shipping, and service.

1. DEFINITIONS AND AGREEMENT

1.1. Definitions:

  • Products: Any audio equipment, components, accessories, or parts sold or supplied by Streamline HiFi.

  • Services: Any installation, repair, consulting, or setup services provided by Streamline HiFi personnel.

  • Agreement: These Terms of Sale, including the Limited Warranty and all incorporated policies.

1.2. Acceptance:

This Agreement constitutes the entire agreement between Streamline HiFi and the Buyer. No modifications or waivers of this Agreement are valid unless in writing and signed by an authorized representative of Streamline HiFi.

2. PRICING, PAYMENT, AND ORDER ACCEPTANCE

2.1. Pricing: All prices advertised are subject to change without notice. The price charged will be the one in effect at the time the order is accepted. 2.2. Payment: Payment must be received by Streamline HiFi prior to acceptance of an order. We accept major credit cards, bank transfers, and other methods as specified on our website. 2.3. Order Rejection: Streamline HiFi reserves the right to accept or reject any order for any reason, including unavailability of the Product, errors in the description or price of the Product, or an error in your order.

3. SHIPPING, RISK OF LOSS, AND TITLE

3.1. Shipping: Streamline HiFi will use reasonable efforts to meet specified delivery dates, but is not responsible for delays caused by the carrier, customs, or other factors outside our control. 3.2. Risk of Loss: Risk of loss or damage to Products passes to the Buyer upon Streamline HiFi’s delivery of the Product to the carrier. Claims for shipping damage must be made directly to the carrier. 3.3. Title: Title to the Products passes to the Buyer upon full payment for the Products.

4. CANCELLATIONS, RETURNS, AND REFUNDS

4.1. Order Cancellation:

If after making a purchase and ordering a console, you change your mind and want to cancel your order, you must do so within 24 hours to receive a refund. Credit card transaction fees occur instantly and are nonrefundable by the credit card processing company. Thus, refunds requested within 24 hours of the order will be made for the amount of the order minus a 5% transaction fee. If the Product has shipped, the return policy (4.2) applies. Custom or special-order Products may not be canceled.

4.2. Returns and Refunds (The "Return Policy"):

Refunds / Returns Policy:

Each Streamline HiFi stereo console is custom-built and a one-of-a-kind unit, handmade to order. Because of this dynamic in production, we do not accept returns, nor do we make refunds once the manufacturing process has begun. We do, however, provide a one-year warranty on all stereo consoles that we make.

Delivery and Non-Delivery of Item(s):

All Streamline HiFi products are shipped through independent third-party delivery services. Once an item has been released to the carrier, responsibility for safe transit and timely delivery rests solely with that carrier. Streamline HiFi is not liable for any loss, delay, damage, or non-delivery that occurs while the item is in transit.

If an order does not arrive as scheduled, the buyer must notify both Streamline HiFi and the delivery service in writing within five (5) days of the scheduled delivery date. In such cases, Streamline HiFi’s responsibility is limited to assisting the buyer in filing a claim with the carrier.

Inspection and Delivery Policy:

We want our customers to love their Streamline HiFi custom-built console and/or other item the moment the delivery arrives. For that reason, we ask that buyers carefully inspect item(s) within five (5) days of delivery. If a buyer notices anything that does not match the order, we require written notification within that five (5) day period with supporting details and/or photos.

 

For clarity, “nonconforming goods” means only:

  • The item delivered is different from what was ordered; or

  • The label or packaging does not accurately identify the contents.

If a purchaser notifies us within the five (5) day period, Streamline HiFi will either:

  • Arrange to replace the item with the correct one, or
  • Provide a credit or refund for the affected item(s).
 

Please Note: Our products are delivered by trusted, independent third-party carriers. Once an order leaves our workshop, the carrier is solely responsible for the safe handling, timely delivery, and condition of the item(s) while in transit. Streamline HiFi is not liable for any loss, damage, or delay during shipping. If such an issue arises, we’ll gladly help coordinate with the carrier and will provide the documentation needed to support a claim.

If an item must be returned due to a confirmed nonconformity, the buyer is responsible for return shipping and any associated risks. Replacement shipping costs are also the buyer’s responsibility. Except for the specific situations described above, all sales are final.

5. LIMITED WARRANTY AND DISCLAIMER

5.1. StreamlineHiFi Limited Product Warranty

Streamline HiFi warrants that new Products purchased directly from us will be free from defects in materials and workmanship for a period of one (1) year from the date of original delivery (“Warranty Period”).

  • Remedy: If a defect arises and a valid claim is received within the Warranty Period, Streamline HiFi will, at its sole discretion: (i) repair the Product using new or refurbished parts; (ii) replace the Product with a new or refurbished Product; or (iii) refund the purchase price of the Product.

  • Exclusions: This Limited Warranty covers only manufacturing defects and does not cover:

    • Normal wear and tear (e.g., cosmetic scratches, fading).

    • Damage caused by misuse, abuse, accidents, improper installation, or electrical surge/fire/flood.

    • Products modified, altered, or repaired by anyone other than Streamline HiFi or an authorized service center.

    • Defects caused by failure to follow Product instructions or operating the Product outside its specified environmental or electrical parameters.

  • Buyer represents and warranties that it understands the following:

    • Wood is a natural product and can move and shift in different environments. Seller is not responsible for neglectful environmental decisions. By way of example and not limitation, if Buyer places its purchased console in front of a south facing window in an environment that has a lot of sun and big temperature fluctuations and the wood warps, cups or bows, Seller is not responsible for any damage or alteration of the natural product used to manufacture the console.

    • Amplifiers have high electricity moving through them and are to be respected and taken care of. The amplifier shall be worked on and maintained by a professional to avoid electrocution. Seller is not responsible for any damage or injury caused to Buyer during maintenance or repair to any Good sold hereunder.

    • Turntable and Sonos, WiiM Port are products manufactured by a third party (“Third-Party Product”) may constitute, contain, be contained in, incorporated into, attached to, or packaged together with, the Goods. Third-Party Products are not covered by any warranty in provided by Seller and may be warranted those the Third-Party Product manufacturer. For the avoidance of doubt, SELLER MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO ANY THIRD-PARTY PRODUCT, INCLUDING ANY (i) WARRANTY OF MERCHANTABILITY; (ii) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; (iii) WARRANTY OF TITLE; OR (iv) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE.

5.2. Service Warranty

Streamline HiFi warrants that Services performed will be performed in a professional and workmanlike manner. If the Service is found defective, the Buyer’s sole remedy is re-performance of the Service.

5.3. Warranty Disclaimer (MANDATORY LEGAL CLAUSE)

EXCEPT AS EXPRESSLY PROVIDED IN SECTION 5.1, STREAMLINE HIFI MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

STREAMLINE HIFI EXPRESSLY DISCLAIMS ANY WARRANTY OR REPRESENTATION THAT THE PRODUCTS WILL MEET THE BUYER’S SPECIFIC NEEDS OR THAT THE OPERATION OF THE PRODUCTS WILL BE UNINTERRUPTED OR ERROR-FREE. THE LIMITED WARRANTY GRANTED HEREIN IS IN LIEU OF ALL OTHER WARRANTIES.

6. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STREAMLINE HIFI SHALL NOT BE LIABLE TO THE BUYER OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF REVENUE, OR LOSS OF DATA), EVEN IF STREAMLINE HIFI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL STREAMLINE HIFI’S TOTAL LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT, THE PRODUCTS, OR THE SERVICES EXCEED THE ACTUAL AMOUNT PAID BY THE BUYER FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

7. INDEMNIFICATION

THE BUYER AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS STREAMLINE HIFI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING OUT OF OR IN CONNECTION WITH:

  1. THE BUYER’S MISUSE, MODIFICATION, OR INCORRECT INSTALLATION OF THE PRODUCTS;

  2. THE BUYER’S VIOLATION OF ANY TERM OF THIS AGREEMENT OR ANY APPLICABLE LAW OR REGULATION; OR

  3. ANY CLAIM BY A THIRD PARTY RELATED TO THE PRODUCTS OR SERVICES PROVIDED TO THE BUYER.

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. 8.2. Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach thereof, shall be subject to mandatory binding arbitration.

9. GENERAL PROVISIONS

9.1. Severability: If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired. 9.2. Entire Agreement: This Agreement supersedes all prior or contemporaneous oral or written agreements, understandings, or representations relating to the subject matter herein. 9.3. Contact Information: For all warranty or service claims, or general inquiries, the contact information will be the same as the contact information of this purchase.
